Sexual Harassment FAQ
What is Sexual Harassment?
Sexual harassment is defined as unwelcome advances of a sexual nature. Most instances of sexual harassment occur within the work place, but may happen in another type of setting, such as an academic environment. Employment Law defines sexual harassment as any unwelcome sexual advance or sexual conduct within the work environment, such that the work environment becomes hostile or intimidating.
What behaviors are considered Sexual Harassment?
Common behaviors that may be considered sexual harassment are: inappropriate touching, inappropriate physical contact, offense or lewd emails, offensive or lewd language, unwelcome sexual advances, unwanted sexual flirtation, and inappropriate sexual remarks.
What should I do if I believe I am being sexually harassed?
The first thing you should do is speak with your manager or your company’s human resources department about the harassment. If the person harassing you is your manager, you should speak with the person above your manager. It is important to report abuse and also to document incidents, dates, and times of abuse. If your company fails to take action, you should seek counsel from a skilled sexual harassment attorney to review your rights and legal options.
Why should I speak with an attorney?
Incidents and accusations of sexual abuse may be difficult for a person to prove, especially when he/she feels his/her job and reputation is at risk. By working with an attorney, you will receive the guidance and compassion you need to move forward with your legal matter. Additionally, you will be provided with valuable advice and resources that will make you feel at ease during this time. You attorney will also make sure that your rights and best interests remain protected throughout the case process.
Am I entitled to monetary compensation?
In some cases, you may be entitled to monetary compensation from the harasser and/or your employer to cover things such as your: lost wages, lost quality of life, and pain and suffering.
